Orange County Paternity Cases

Paternity cases typically involve 4 issues and not all of them apply to every case – DNA testing, child custody and visitation, child support and attorney’s fees.

With the except of DNA testing, the other three issues are no different than a divorce case. The court uses the same “best interest” analysis when it evaluates custody and visitation, child support is based on what we call “guideline” (which is determined by a computer assisted program that allows lawyers and judges to input certain factors and obtain a child support number) and attorney’s fees are based on one parent’s need and the other’s ability to pay.

The biggest difference of course is there are no assets or debts to divide and, for that reason, paternity cases are far more simple and hopefully less expensive to resolve.
